1. Scope and incorporation
This Acceptable Use Policy (“AUP”) describes uses of conversionate.com, gmaps.conversionate.com, and any related products, websites, mobile applications, APIs, features, and content (collectively, the “Service”) that are prohibited. The AUP supplements, and is incorporated by reference into, our Terms & Conditions and our Subscription Agreement. If any provision of this AUP conflicts with a term in the Terms & Conditions or the Subscription Agreement, the applicable provisions of those documents control, unless the term in this AUP specifically states that it controls.
You are responsible for ensuring that your use of the Service, and the use of anyone using the Service through your account or with your permission, complies with this AUP at all times.
2. Self-help suspension
If you violate this AUP, Conversionate may, in its sole discretion, suspend, restrict, or terminate your account and your access to the Service, in whole or in part, with or without notice, and pursue any other remedy available at law or in equity. Conversionate’s right to suspend or terminate applies even if a violation was committed unintentionally, by an unauthorized user of your account, or by an end-user you support, if Conversionate believes that suspension or termination is reasonably necessary to ensure compliance with applicable law or to protect the rights, safety, privacy, security, or property of Conversionate, its customers, or any third party.
3. Intellectual-property infringement
You may not use the Service in any manner that infringes, dilutes, misappropriates, or violates any intellectual property or proprietary right of any person, including without limitation copyrights, trademarks, service marks, trade dress, rights arising from patents, trade secrets, rights of publicity, or moral rights. You will not use the Service to upload, store, transmit, distribute, or otherwise make available any content that you do not have the necessary rights to use.
4. Harmful, malicious, or illegal content
You may not use the Service to transmit, store, display, distribute, or otherwise make available any content, software, technology, or data that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, or data, including without limitation viruses, Trojan horses, ransomware, bots, worms, scripting exploits, time bombs, or any other malicious code; or any content that is unlawful, defamatory, threatening, harassing, abusive, fraudulent, obscene, child-sexual-abuse material, content that promotes violence or self-harm, hate speech, or any content that violates the law of any jurisdiction relevant to your use.
5. Service-specific rules for Google Maps Fixer
You agree that, in connection with Maps Fixer, you will:
- only request analysis and changes for Google Business Profiles you own, manage, or have written authority to operate;
- comply at all times with Google’s Guidelines for Representing your Business on Google and any other applicable policy of Google or its affiliates;
- not impersonate any business, brand, person, or entity, or mislead Google’s users about the identity, location, categories, services, or hours of any business;
- review every proposed change in the Service before approving it, and only approve changes that are accurate, lawful, and authorized;
- not use the Service to obtain or maintain a Business Profile that violates Google’s policies (for example, ineligible business types, prohibited content, misrepresentation of services, fake locations);
- revoke our Google access promptly if you no longer want us to maintain access, by signing out at myaccount.google.com/permissions.
6. Service-specific rules for AI features
You agree that you will not:
- attempt to extract, recreate, reconstruct, or reverse-engineer any model, prompt, system prompt, fine-tuning data, weights, or training data underlying any AI feature of the Service;
- use the Service to generate or distribute content that violates the usage policies of the underlying AI providers (including, without limitation, those of OpenAI and Anthropic);
- use the Service to generate content designed to deceive, defraud, manipulate, harass, or harm any person, or to facilitate the violation of any law or regulation;
- use the AI features to make decisions that have legal or similarly significant effects on any person without independent human review and approval;
- present AI Output as your own original human-authored work in contexts where that representation is misleading or unlawful; or
- use the Service’s AI features to develop or improve a product or service that competes with the Service.
7. No framing, scraping, or unauthorized automation
You may not frame, mirror, embed, or reproduce the Service (in whole or in part) without our express prior written consent. You may not use any robot, spider, site search/retrieval application, scraper, harvester, or other manual or automated means to retrieve, index, scrape, data-mine, or otherwise gather any messages, text, files, images, photos, video, audio, profiles, AI Output, or any other content from the Service, or to reproduce or circumvent the navigational structure or presentation of the Service, without our express prior written consent.
We grant operators of public search engines a limited, revocable permission to use spiders to copy publicly accessible portions of our marketing pages solely for the purpose of, and to the extent strictly necessary for, creating publicly available searchable indices of such material — but not caches or archives. We reserve the right to revoke this exception either generally or in specific cases at any time.
8. Email, messaging, and anti-spam
You may not use the Service to transmit unsolicited email, SMS, or other messages, including (without limitation) unsolicited bulk email (“spam”), or email or messages that are excessive, that harass or annoy, or that violate the U.S. CAN-SPAM Act, the U.S. Telephone Consumer Protection Act, Canada’s CASL, the U.K.’s Privacy and Electronic Communications Regulations, the EU ePrivacy Directive, or any other applicable anti-spam or tele-marketing law.
You may not continue to send email or other messages to a recipient who has indicated they do not wish to receive them. You may not alter or obscure email or message headers, spoof, phish, or assume a sender’s identity without that sender’s explicit permission. If you use the Service to send marketing communications to your own contacts, you are responsible for obtaining valid consent and honoring unsubscribe requests.
9. System security
You may not use the Service to violate the security or integrity of any network, computer, communications system, software application, or computing device (each, a “System”), including (without limitation) by attempting to: (a) probe, scan, or test the vulnerability of a System, or breach or circumvent security or authentication measures, without authorization; (b) make network connections to, or otherwise access, a System without authorization; (c) monitor data or traffic on a System without authorization; (d) tamper with, reverse-engineer, hack, interfere with, disrupt, or disable a System, including (without limitation) by means of overloading, flooding, mail-bombing, crashing, or denial-of-service attacks; (e) forge any TCP/IP packet header or any part of any header information in any email, message, or posting; (f) use another party’s account, identity, or persona without authorization; or (g) take any action to obtain any service, feature, or content of the Service to which you are not entitled.
10. Privacy of others
You may not use the Service to violate the privacy or confidentiality of others, including by transmitting, storing, displaying, distributing, or otherwise making available others’ private or confidential information (including, without limitation, their account names or any personal data associated with their Service or third-party account) without authorization, or by using the Service to identify, track, harass, or monitor any person without their consent.
11. Compliance with laws
Without limiting any other prohibition in this AUP, you may not use the Service for any illegal purpose or in violation of any applicable law or regulation, including (without limitation) data-protection, privacy, consumer-protection, advertising, telemarketing, anti-money-laundering, anti-corruption, anti-bribery, sanctions, and export-control laws.
12. No high-risk use
You may not use the Service in any situation where failure or fault of the Service could lead to death, serious bodily injury, or significant physical or environmental damage. For example, you may not use, or permit any other person to use, the Service in connection with critical medical decisions, aircraft or other modes of human mass transportation, nuclear or chemical facilities, weapons systems, or any other safety-of-life infrastructure.
13. Responsibility for end users
You are responsible for any violation of this AUP by anyone using the Service with your permission or using your account on an unauthorized basis. Your use of the Service to assist any other person in an activity that would violate this AUP if performed by you is itself a violation of this AUP. Each prohibition in this AUP applies to, and includes, any action directly or indirectly taken, authorized, facilitated, promoted, encouraged, or permitted by you, even if you did not personally violate the prohibition.
14. Monitoring and enforcement
Conversionate reserves the right, but does not assume the obligation, to investigate any violation of this AUP or any misuse of the Service. Conversionate has the right, in its sole discretion, to edit, refuse to post, or remove any material submitted to or posted on the Service that Conversionate finds to be in violation of this AUP, or that Conversionate finds objectionable for any reason, with or without notice and without liability.
Conversionate may report any activity that it suspects violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. Such reporting may include disclosure of appropriate customer data. Conversionate may also cooperate with appropriate law enforcement agencies, regulators, or other appropriate third parties to assist in the investigation and prosecution of illegal conduct, including by providing network and systems information related to alleged violations of this AUP.
15. Reporting violations
If you become aware of any actual or suspected violation of this AUP, you must promptly notify Conversionate at hello@conversionate.com (subject line “AUP Report”) and provide reasonable assistance, as requested, to stop or remedy the violation. We treat reports of abuse seriously and may, at our option, share information about reports with affected parties.
16. Indemnification and remedies
You agree to defend, indemnify, and hold harmless Conversionate and its Indemnitees (as defined in the Terms & Conditions) from and against any and all Losses arising out of or related to any breach by you of this AUP. In addition, Conversionate’s right to suspend or terminate your access for breach of this AUP is cumulative with, and not exclusive of, any other rights and remedies Conversionate may have at law or in equity.
17. Updates to this AUP
Conversionate may modify this AUP at any time by posting a revised version on the Service. By accessing or using the Service, you agree to the latest version of this AUP. We will update the “Last updated” date when we make material changes and, where required by law, provide additional notice.
